Terms of Service — MigraineMe

    Please read these terms carefully. By downloading or using MigraineMe, you agree to be bound by these Terms of Service. If you do not agree, please do not use the app.
  

1. About MigraineMe

MigraineMe is a personal health tracking application designed to help users log migraines, symptoms, treatments, and related health data. It is operated by Jordy Verwerft ("we", "our", "us").

      Medical disclaimer: MigraineMe is not a medical device and is not regulated as one. It does not diagnose, treat, cure, or prevent any medical condition. All insights, risk scores, and recommendations are for informational purposes only. Always consult a qualified healthcare professional before making any medical decisions.
    

2. Eligibility

You must be at least 16 years old to use MigraineMe. By using the app, you confirm that you meet this requirement. If you are using the app on behalf of a minor, you take full responsibility for their use.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

Use the app for any unlawful purpose
Attempt to gain unauthorised access to any part of the app or its infrastructure
Reverse engineer, decompile, or disassemble any part of the app
Upload or transmit any content that is harmful, offensive, or violates the rights of others
Use the app to harass, abuse, or harm other users through the community features
Scrape or extract data from the app by automated means

5. Community Guidelines

MigraineMe includes community features such as a forum and discussion boards. When participating, you agree to:

Be respectful and considerate of other users
Not share medical advice presented as professional guidance
Not post spam, promotional content, or misleading information
Not share other users' personal information without their consent

We reserve the right to remove any content that violates these guidelines and to ban users who repeatedly violate them.

6. Your Data

You retain full ownership of the health data you enter into MigraineMe. By using the app, you grant us a limited licence to store and process your data solely for the purpose of providing the app's features to you.

We will never sell your data or use it for advertising. See our Privacy Policy for full details on how we handle your data.

7. Premium Subscription

MigraineMe offers a premium subscription that unlocks additional features including AI-powered daily insights, advanced analytics, and more. Subscriptions are managed through Google Play and are subject to Google's billing terms.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
You can manage and cancel your subscription in your Google Play account settings
Refunds are handled in accordance with Google Play's refund policy
We reserve the right to change pricing with reasonable notice

8. Third-Party Integrations

MigraineMe integrates with third-party services such as WHOOP, Garmin, Google Health Connect, and others. Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the availability or accuracy of data provided by third-party services.

9. Intellectual Property

All content, design, code, and branding within MigraineMe is owned by or licensed to us. You may not reproduce, distribute, or create derivative works from any part of the app without our express written permission.

10. Limitation of Liability

To the fullest extent permitted by law, MigraineMe and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to health decisions made based on app data or insights.

The app is provided "as is" without warranties of any kind, express or implied.

11. Termination

You may stop using MigraineMe at any time and request deletion of your account and data. We may terminate or suspend your access if you violate these terms. Upon termination, your right to use the app ceases immediately.

12. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes through the app. Continued use of MigraineMe after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
